In accordance with the GDPR regulations (“the Act” or “Regulations”), Daxil, hereby provides its customers, including prospective customers, and third parties generally (e.g. trustees, legal representatives, etc.) who contact them on behalf of customers, including prospective customers (“Data Subjects”), with the information required by law in relation to the processing of their personal data (“Data”).

HOW WE COLLECT PERSONAL DATA 

 

The data to be processed by the Controller can be obtained: 

– from the Data Subject, including through remote communication methods used by the Controller (e.g. websites, smartphone and tablet applications, etc.); 

– from third parties (e.g. persons organizing transactions on behalf of the Data Subject, commercial companies and companies providing information, etc.). 

Data from public sources, such as public registers, lists, documents that can be consulted by anyone, as well as data obtained from sources that are publicly available, such as printed or electronic newspapers, information taken from telephone directories, websites of government agencies or other regulatory and supervisory bodies, will also be used.

State-provided identification (passport, residence permit, driver’s license, passport number, driver’s license information), address, photo, video. Information about the device being used, including hardware model, operating system and its version, as well as unique device identifiers, etc, IP address, public addresses of blockchain networks.

We do not collect and ask you not to provide us with information that is subject to certain legal restrictions and requirements, such as racial or ethnic origin, political, religious or philosophical beliefs, membership of political parties and trade unions, criminal convictions or suspected criminal offenses, and health, gender, biometric or genetic information.

We use cookie technology to collect additional data about your use of the Site and to improve the Site, to improve our services. DATA PROCESSING PURPOSE 

LEGAL GROUNDS FOR DATA PROCESSING 

Registering and processing requests for contact information.  

The processing of the personal data of the data subject is carried out in order to carry out preliminary and follow-up activities related to registration requests, information and contact management and/or sending information materials, as well as to fulfill any other obligations arising therefrom. 

The legal basis for such processing is the provision of services corresponding to the registration request, the provision of information and contact details and/or the sending of information materials, as well as the fulfillment of legal obligations. 

Submission of data is not mandatory. 

However, any refusal by the person concerned to provide the data shall make it impossible for the controller to provide the service requested. 

6(1)(b) GDPR 

Contractual Relationship Management. 

The processing of the data subject’s personal data is carried out for the purpose of performing activities before and after the purchase of the Service and/or product, such as, for example, managing the relevant order, providing the Service itself and/or the purchased product, billing and payment management, processing complaints and/or service reports, as well as providing assistance, sending messages with content and fulfilling any other obligations arising from the contract. 

The legal basis for such processing is the provision of services characteristic of a contractual relationship and compliance with legal obligations. 

The provision of data is not mandatory, but any refusal by the person concerned to provide data shall make it impossible for the controller to provide the requested services. 

6(1)(c) GDPR 

Defense of the right in court or out of court. 

The processing of the Data Subject’s personal data is carried out for the purpose of establishing the exercise or defense of the Controller’s right and/or defending against claims of other persons in judicial or extrajudicial proceedings. 

The legal basis for such processing is the realization of the legitimate interests of the Controller, taking into account the balance of the rights of the latter and the Personal Data Subject. 

6(1)(f) GDPR 

General and computer security. 

Processing of personal data of the data subject is carried out for the purpose of ensuring network and information security, protection of the company’s corporate assets and security of Daxil’s offices and corporate systems. 

The legal basis for such processing is compliance with the legal obligations and the realization of the legitimate interests of the Controller, taking into account the balance of rights between the Controller and the Data Subject. 

The data subject has the right to object at any time, for reasons relating to his/her personal situation, to the processing of personal data concerning him/her for the purpose in question. 

Fraud Prevention. 

The processing of the personal data of the personal data subject is carried out to ensure control in order to monitor and prevent fraudulent activities and payments, by means of software systems that perform checks in automated mode and before the approval of the service/product. Failure to carry out such checks with a negative result makes it impossible to carry out the transaction.  

The interested party may in any case express his/her opinion, obtain clarifications or appeal against the decision by explaining the reasons for the decision to the Customer Service or at  https://daxil.com.    

The legal basis for such processing is the realization of the legitimate interests of the Controller, taking into account the balance of the rights of the latter and the Data Subject. 

The data subject shall have the right to object at any time, for reasons relating to his/her personal situation, to the processing of personal data concerning him/her for the purpose in question

5(1)(a)) GDPR 

Shares for services/goods similar to those purchased.  

The processing of the Personal Data Subject’s personal data is carried out for the purpose of sending emails related to promotions and offers of the Controller’s services/products, which are identical and/or similar to those covered by the current contract with the Personal Data Subject, unless the Personal Data Subject objects to such processing initially or during further communications. 

The legal basis for such processing is the legitimate interest of the Controller to promote products or services in which the customer may have a legitimate interest, taking into account the balance between the rights of the latter and the Controller. 

The data subject shall have the right to object at any time, for reasons relating to his or her personal situation, to the processing of personal data concerning him or her for the purpose in question. 

Promotional activities regarding the services/products offered by Daxil.  

The personal data of the data subject is processed for the purpose of sending (subject to specific consent) messages about promotions and offers of the Owner’s services/products by traditional means (e.g. by regular mail, telephone calls with the operator) and/or automated means (e.g. by e-mail, SMS, MMS, pre-recorded telephone calls). 

The legal basis for such processing is the consent given by the data subject prior to the processing itself, which may be freely withdrawn at any time without prejudice to the lawfulness of the previous processing. 

Any refusal by the data subject to provide consent shall entail the following 

inability to use the respective services without any negative consequences for the contractual relationship with the data controller. 

Profiling. 

The processing of the personal data of the data subject is carried out, with specific consent, for profiling purposes, for example to analyze the data transmitted and the services/products purchased, in order to offer promotional messages and/or commercial offers according to the choices made by users. 

The legal basis for such processing is the consent given by the data subject prior to the processing itself, which may be freely withdrawn at any time without prejudice to the lawfulness of the previous processing. 

Any refusal by the data subject to provide consent shall entail the following

Subjects in these categories act independently as individual Data Controllers or as Data Processors assigned by the Data Controller. 

The data may also be known, in connection with the performance of assigned tasks, to the Controller’s staff, including interns, temporary workers, consultants and specially authorized data processors. Personal data will in no case be disseminated and therefore will not become known to unidentified persons in any form, such as by giving them access to it or viewing it. 

 

HOW WE PROCESS DATA  

 

Data shall be processed by manual, computerized and telematic means and in compliance with the necessary measures provided for in the regulations to ensure confidentiality, integrity and availability of data and to prevent damage, both material and non-material. 

 

WHERE WE PROCESS THE DATA  

 

Personal data of the Data Subject is stored in archives located within the European Union. If it is necessary to achieve the stated purposes, the Data Subject’s data may be transferred abroad, to countries/organizations outside the EU that guarantee a level of personal data protection deemed sufficient by the European Commission in its decision, or on the basis of other appropriate safeguards such as the Standard Contractual Clauses adopted by the European Commission, or with the Data Subject’s consent. The Data Subject has the right to obtain a copy of such guarantees, as well as a list of the countries/organizations to which the data has been transferred, by writing to the following e-mail address support@daxil.com    

 

HOW LONG WE KEEP STAKEHOLDER DATA 

 

The Data will be kept in a form that allows the identification of the Data Subject for a period not exceeding the period necessary to fulfill the purposes for which it was collected, taking into account the laws applicable to the activities and sectors in which the Data Controller operates. Upon expiration of the established period, the Data will be deleted or transformed into an anonymous form, unless their continued retention is necessary to fulfill obligations (e.g. tax and accounting) that remain even after termination, or to comply with orders issued by public authorities and/or supervisory bodies. 

 

WHAT RIGHTS THE DATA SUBJECT HAS
